Pre-Order and On-Demand Product Cancellation Policy

1. Scope

This policy applies to physical music products identified on our online store - website as:

● Pre-order;

● Forthcoming release;

● Advance reservation;

● On demand;

● Made to order;

● Special production; or

● Awaiting publication, manufacture or supply.

These products may not have been manufactured, published, or released when the order is placed. Estimated publication and delivery dates are supplied in good faith but are not guaranteed.

Nothing in this policy limits or excludes any rights available to consumers under applicable law.

2. Order acknowledgement and acceptance

After an order is submitted, we will send an acknowledgement confirming that we have received it. This acknowledgement does not necessarily mean that the order has been accepted.

Unless we expressly state otherwise, the contract between you and The Sound of Tape is formed when we send an order acceptance or dispatch confirmation.

We reserve the right to decline or cancel an order before acceptance where:

● The product has been cancelled or withdrawn by the artist, record label, publisher, manufacturer, or distributor;

● The product is unavailable, or we cannot obtain the required allocation;

● A material error appears in the product description, format, specification or price;

● Payment cannot be authorised or verified;

● We reasonably suspect fraud, misuse, or an unlawful transaction; or

● We are unable to supply the product for reasons beyond our reasonable control.

If we cancel an order after taking payment, all amounts paid for the cancelled product will be refunded to the original payment method.

3. Pricing of pre-order products

We reserve the right to publish the pre-order pricing in advance. Prices and product specifications for unreleased products may initially be based on provisional information supplied by the artist, label, publisher, musicians, studio, manufacturer, or distributor.

We may update the advertised price for future orders at any time before publication. However, once we have accepted your order, we will not increase the agreed price without first notifying you and obtaining your express agreement.

If the supplier’s price, taxes, exchange rate, production costs, or product specifications change materially before release, we may offer you the following choices:

1. Proceed with the order at the revised price;

2. Select an alternative product, where available; or

3. Cancel the affected product and receive a full refund.

You will not be charged a higher price automatically without your express agreement.

We reserve the right to correct an obvious pricing error. If an obvious error is identified after an order has been submitted, we will contact you before proceeding. You may accept the corrected price or cancel for a full refund.

4. Customer cancellation before dispatch

Unless a statutory exception applies, a consumer may request cancellation of a pre-order at any time before dispatch.

To request cancellation, please contact us and provide:

● Your full name;

● Order number;

● Product title; and

● A clear statement that you wish to cancel.

Where cancellation is permitted, we will refund the amount paid for the cancelled product, including any standard delivery charge attributable solely to that product.

5. Cancellation after delivery

For most physical products purchased online, UK consumers have the right to cancel without giving a reason from the date the contract is formed until 14 days after the day on which the goods are received.

After notifying us of the cancellation, you must return the goods within 14 days. Unless the goods are faulty, damaged, incorrectly supplied, or otherwise not as described, you are responsible for the direct cost of returning them.

Products must be handled only to the extent reasonably necessary to establish their nature, characteristics, and functioning. We may make a lawful deduction from the refund if handling has reduced the value of the goods.

6. Sealed audio and video products

The statutory right to cancel does not apply to sealed audio recordings, sealed vinyl, sealed reel tape, sealed audio cassette, video recordings or sealed physical music recordings once the product has been unsealed after delivery.

This may include sealed:

● Reel Master Tapes;

● Vinyl LP Records, and UHQ-LPs;

● Crystal Disc CDs, Audio CDs, and UHQ-CDs;

● Audio Cassette Tapes;

● Blu-ray and DVD products; and

● Other sealed recorded-media products.

Please inspect the exterior packaging before breaking the seal. This exception does not affect your rights where a product is faulty, damaged, incorrectly supplied or not as described.

7. Genuinely personalised products

The statutory change-of-mind cancellation right may not apply to goods made to the customer’s specifications or clearly personalised for that customer.

A standard catalogue product manufactured or duplicated on demand is not necessarily a personalised product merely because production begins after the order is received.

Where a product is genuinely personalised, we will identify this clearly before purchase. Examples may include a product carrying a customer-selected inscription, unique configuration or other individual specification.

This exception does not affect the customer’s rights where the goods are faulty, damaged, incorrectly supplied or not as described.

8. Production and publication delays

Release and delivery dates for pre-order and on-demand products are estimates unless expressly confirmed as guaranteed.

Dates may change because of:

● Manufacturing or duplication delays;

● Approval by artists, labels or rights holders;

● Changes to masters, artwork, packaging or specifications;

● Quality-control requirements;

● Transport or customs delays;

● Allocation restrictions; or

● Other circumstances beyond our reasonable control.

Where a revised delivery date is required, we will provide an update as soon as reasonably practicable. If the delay is substantial, we may ask whether you wish to continue waiting or cancel for a full refund.

If an agreed essential delivery deadline cannot be met, you may have the right to cancel under applicable consumer law.

9. Product changes before publication

The RRP pricing, release artwork, cover design, track listings, tape stock, reel tape spool colour, packaging, numbering, technical specifications, and other release details may be provisional before final publication.

We may make minor changes that do not materially alter the product. If the artist, label, publisher or manufacturer makes a material change, we will notify affected customers and offer the opportunity to:

● Accept the revised product;

● Select an available alternative; or

● Cancel and receive a full refund.

10. Discontinued or cancelled releases

If a release is permanently cancelled, discontinued, or cannot be supplied, we will cancel the affected order and issue a full refund.

We will not substitute a materially different edition, format or specification without the customer’s agreement.

11. Refunds

Approved refunds will be made to the original payment method without undue delay and normally within 14 days of the applicable cancellation event.

For returned goods, we may withhold the refund until we receive the goods or you provide evidence that they have been returned, whichever occurs first.

Processing times shown by banks, card issuers, and payment providers are outside our control.

12. Faulty, damaged, or incorrectly supplied products

This cancellation policy does not restrict your rights under the Consumer Rights Act 2015.

Products must be of satisfactory quality, fit for purpose, and as described. Please contact us promptly if your order arrives damaged, faulty, incomplete, or materially different from its description.

13. Business customers

Statutory consumer cancellation rights apply to individuals acting wholly or mainly outside their trade, business, craft or profession.

Orders placed by businesses, trade customers, distributors or professional buyers may be governed by separate commercial terms. Unless otherwise agreed in writing, business pre-orders may not be cancelled after we have committed funds to a supplier or authorised production.

14. Contacting us

Please retain proof that your cancellation request was submitted. We will confirm receipt and advise you of any return instructions.

15. Governing law

These terms are governed by the laws applicable in the United Kingdom. Nothing in these terms affects any mandatory rights that you may have under the law of the country in which you reside.
